AN ORDINANCE
AUTHORIZING SIGNATURE OF A PERMANENT EASEMENT TO THE CONSOLIDATED MUTUAL WATER COMPANY FOR A FIRE HYDRANT AND RELATED APPURTENANCES ACROSS THE CHARLES E. WHITLOCK RECREATION CENTER PROPERTY LOCATED AT 1555 DOVER STREET
WHEREAS, The Consolidated Mutual Water Company has requested the City of Lakewood convey to them an easement for the construction and use of a fire hydrant and related appurtenances across land owned and used by the City as part of the Charles E. Whitlock Recreation Center; and
WHEREAS, the City of Lakewood is willing to agree to convey the easement to The Consolidated Mutual Water Company.
WHEREAS, the Charter of the City of Lakewood provides, in Section 14.3 thereof, that utility easements may be granted across property held for open space or parks purposes, which the City is willing to do.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest an Easement and Right-of-way Agreement, in form approved by the City Attorney, to The Consolidated Mutual Water Company across the land described in Exhibit "A" attached hereto and made a part hereof, for a fire hydrant and related appurtenances.
SECTION 2. This ordinance shall take effect thirty (30) days after final publication.
I hereby attest and certify that the within and foregoing ordinance was introduced
and read on first reading at a regular meeting of the Lakewood City Council
on the 9th day of June, 2008; published by title in the Rocky Mountain News
and on the City of Lakewood's website, www.lakewood.org., on the 12th day of
June, 2008; set for public hearing on the 23rd day of June, 2008; read, finally
passed and adopted by the City Council on the 23rd day of June, 2008, and signed
and approved by the Mayor on the 24th day of June, 2008.

Exhibit "A"
A parcel of land being a part of Lot 20, Block 2, MAJOR ERROR CORRECTION TO SMITH'S SUBDIVISION LOT LINE ADJUSTMENT NO. 2 PLAT, the plat of which is recorded in Plat Book 172, at Page 52, at Reception Number F1801744, of the records of the Jefferson County Clerk and Recorder and further being located in the Southeast One-quarter (SE¼) of Section 34, Township 3 South, Range 69 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, being more particularly described as follows:
The South 25.00 feet of the West 10.00 feet of said Lot 20. The above described parcel contains an area of 250 square feet, more or less.
The foregoing legal description is for a Permanent Easement and was prepared by Ted Van Horn on May 28, 2008, City of Lakewood, Property Management Division, 480 South Allison Parkway, Civic Center South, Lakewood, Colorado 80226-3127. This was based on the Street Construction Plans for the Colfax Avenue Dudley Street to Dover Street Sidewalk Improvement Project.
